Urgent Alert - File a Witness Slip on HB 3223 Today
House Bill 3223 will be considered in the Senate Education Committee at 1 p.m. Tuesday. The bill creates a multitude of onerous, unfunded requirements for school districts involving the delivery of services and confidentiality provisions that do not permit school officials to respond appropriately to the needs of students who are parents, expectant parents, or victims of domestic or sexual violence.
- Threatens students' due process rights by prohibiting students facing suspension/expulsion from directly questioning or having contact with an alleged victim of sexual abuse. HB 3223 would only allow a student or their representsative to suggest questions for the school board or hearing officer to ask the alleged victim, at the board or hearing officer's discretion.
Requires districts must appoint at least one staff member per school to be trained to address the needs of youth who are parents, expectant parents, or victims of domestic or sexual violence that must be either a social worker, school psychologist, school counselor, school nurse, or administrator.
Requires that students who are unable to participate in classes on a particular day or time of day must be excused and must be able to make up any examination, study, or work requirement that the student has missed.

The bill creates several onerous mandates for school districts involving the delivery of services and confidentiality requirements that do not permit school officials to respond appropriately to the needs of students who are parents, expectant parents, or victims of domestic or sexual violence.
School officials do everything within their power and resources to accommodate students who are parents, expectant parents, and students with special needs that may arise from any traumatic event. This legislation adds more burdensome regulations and requirements that go beyond the services provided to any other student, despite their need.
